No, he needs to press to stand up. He has to keep standing up. He has to press all the time

How to fix ear? One ear stays up it won’t lay flat...

If it's not stopping it from popping up, I'd say no problem however if it won't flop anymore I'd suggest checking that the tube which runs from the squeeze ball up to ear is pressed back into the hole and if necessary maybe place a piece of tape or a spot of glue to hold it on.
