Yes ... I've been playing it in Windows 8 & 8.1 from a long time now ...

Does this need a CD key? Will I be ok if I buy a used copy?

This does use a cd key, so if you're buying a used copy, be sure it comes with it, however it would be safest to buy new as the program might check the cd key online and if it shows another computer is using the same key it won't work

Are there any digital downloads for this anywhere?

You can always pick up a digital version of the game on the battle.net website itself. You just have to buy Reign of Chaos and The Frozen Throne separately, but they're about 10 bucks each. Find them here: https://us.battle.net/shop/en/product/game/legacy-games

I believe the game can be set in almost any language yet there are a few I didn't see in the list. Like Swahili etc
