Is it true once they re down to 30% battery life it keeps repeating battery low every few minutes?

Currently on my second (about to be third) set since 2019. For the price point I can't complain; after about 2 years the battery life is down to maybe 6-8 hours. The downside, once it hits around 25% battery it says "low battery" about once every 3-5mins for about 15mins and then dies

Does it have active noice cancellation or passive?

Can I swim with these? I see waterproof in the description, but also sweatproof, which makes me nervous that that's the maximum amount of water
